Subject to the conditions set out below, the company warrants that our products will correspond with their specification at the time of delivery and will be free from defects in material and workmanship. Were any genuine defect in either materials or workmanship be found in one of our products, subject to the terms of this warranty, we shall repair, refund or replace the product completely free of charge, for the product’s lifetime. This warranty excludes any damage arising from ordinary wear and tear including but not limited to damage to the fabric occasioned by abrasion, crushed buckles, discoloration due to contact with chemicals or fire/heat damage. It also excludes willful damage, negligence, abnormal working conditions, misuse or any damage arising from personal modification, alteration or repair of the product carried out without our prior approval.
This warranty does not extend to parts, materials or equipment not manufactured by Agilite, in respect of which the customer will only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to Agilite.
Agilite reserves the right to inspection of all products for which this warranty is invoked; this warranty is valid subject only to inspection by a designated Agilite employee, or by its directly authorized agents. In the event of a refund, Agilite will not be liable under any circumstances for any amount in excess of the purchase price of the product. In no event shall Agilite be liable for any special, consequential or incidental damages of any kind arising from the purchase or use of its products under any circumstances. The customer will be responsible for any and all return shipping charges. This warranty applies only to the original purchaser and is non-transferable. Please do not return any product to us without consulting an Agilite customer service representative first.
As expressly provided in this warranty, all other warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
